Dealing with Multiple Objection Letters

Occasionally, an industry user may find they have two open Objection Letters on the same filing. Correctly responding to both Objection Letters is not difficult, but it does require extra attention to detail.

Before making any changes, determine whether any schedule items are referenced on both letters. This can be done by comparing the Objection Letters or by checking the detail information for each Objection icon.

If there are no schedule items that are referenced in both letters, the recommended course is to make all the changes necessary for the Objection Letter received first. After the changes have been made, build and submit the Response Letter in the normal fashion. Click here for additional instructions on building a Response Letter. Once the first Response Letter is submitted, make the changes needed to respond to the remaining Objection Letter, then build and submit the corresponding Response Letter. Following this course should prevent changes from being reflected in the wrong Response Letter. Once both Objection Letters have a Response Letter, the SERFF status will change to Pending State Action.

When one or more schedule items are referenced on both Objection Letters, make note of those items. The recommended course is as above, except it is recommended that for the schedule items referenced on both Objection Letters, all the changes should be made and submitted on the first Response Letter. For the second Objection Letter, simply reference those earlier changes in the appropriate Objection comment field on the Response Letter.
