Confidentiality Requests
What is a Confidentiality Request?
The Public Access Confidentiality feature of SERFF allows industry users to flag the parts of their filings that they consider proprietary or confidential. The state can see the flags on the filing and will review the request per their state laws and regulations. If the request is accepted, the flagged material will not be available via SERFF's Public Access interface.
How Do I Make a Confidentiality Request?
Click the "Set Confidentiality" button. The confidentiality selection window will appear with a list of the elements of the filing that can be marked confidential. Select the appropriate items or choose "Mark entire filing as confidential". When the request is submitted to the state, the selected items will be flagged.
Why is there Nothing in the Selection Window?
Some states do not accept confidentiality requests. Check the top of the selection window for state provided language explaining their Public Access policy. Contact the state directly for questions on this issue.
How Will I Know if My Request was Accepted?
As long as the state does not override the confidentiality request, the confidentiality icon will display on the flagged elements of the filing. The confidentiality icon looks like a pair of glasses with a red circle around it and a line through it.
If the state overrides the request, the filer and any managers for the instance will receive a message in their SERFF Message Center. The circle and line of the icon will change from red to grey.
