What is the Difference?
Response Letter - A Response Letter is sent by the industry to the state to answer questions or correct issues presented in the state's Objection Letter. A Response Letter allows the industry filer to submit revisions to schedule items or add schedule items. These changes may be made on the Form, Rate/Rule or Supporting Document schedules.
Amendment - An Amendment also allows the industry filer to make revisions or additions to the Form, Rate/Rule, or Supporting Documentation schedules. The Amendment process allows the industry to make these changes without first receiving an Objection Letter from the state.
Which Should I Use?
If you have received an Objection Letter from the state, you should answer with a Response Letter. There can only be one Response Letter for each Objection Letter. When every Objection Letter on the filing has a Response Letter, the SERFF Status will change to Pending State Action. For help on creating and submitting a Response Letter click here.
If you have corrections or additions to make to a filing, but the state has not sent an Objection Letter, you should send an Amendment. You can also use the Amendment to answer issues presented by the state in a Note to Filer. Click here for instructions on how to create an Amendment.
When Should I Use the Note to Reviewer?
The Note to Reviewer should only be used to provide general information to the state or to ask the state a question, such as a status check. Unless specifically instructed to do so by the state, never send approvable material on a Note to Reviewer. These items belong on the Form, Rate/Rule, and Supporting Document schedules and are placed there via a Response Letter or Amendment.
Should I Revise or Add a Schedule Item?
If you are making a change to something you have already submitted, you will want to revise that item. If you are sending something not included with the original submission, you will want to add a schedule item. Click here for more information on how to make schedule item revisions and additions.
Why Don't I have a Submit Button?
A Response Letter requires an entry in the Comment field for each Objection. An Amendment requires an entry in the Comment field and the inclusion of at least one schedule item revision or addition. If you have no items to add or revise, you should send a Note to Reviewer instead of an Amendment.
